Crown says it's 'implausible' that man knew his boyfriend had HIVSUPPLIED Mikio Filitonga was found guilty of knowingly infecting partner with HIV. The suggestion a man knowingly had unprotected sex with his HIV positive partner is "implausible", a court has been told. "You must reject the defence contention that [the complainant] knew Mr Filitonga was HIV positive. "Does that sound like a man who knows his partner is HIV positive?" While the rash and fever were consistent with seroconversion - a period following contamination of the HIV virus where antibodies develop - he hadn't reported those symptoms to a doctor.

Murdoch referred to texts the man sent Filitonga asking what his sickness "really is". And they were not texts sent from someone who "vindictively fabricated" a lie after the relationship broke down, Murdoch said. The lawyer told the jurors they had to be certain the man didn't have unprotected sex with another HIV positive man - besides Filitonga - in six months before they met. A text he sent Filitonga in October, after the relationship broke down two months earlier read: "So please tell me now for real, have you got HIV or something? But the defence told the jury they cannot trust the man because his evidence was inconsistent and unreliable.
